Waste Management Rules and EPR in India
SWM Rules 2016 segregation duties, E-Waste EPR recycling targets, the single-use plastic ban's exact dates, hazardous waste TSDFs, and waste-to-energy's record.
A real question on this chapter rarely asks whether India segregates waste into two bins or three. It asks the third category examiners expect you to miss: the Solid Waste Management Rules, 2016 mandate segregation into biodegradable, non-biodegradable and domestic hazardous waste, not the wet-dry pair most aspirants default to. The same trap repeats across this chapter: an e-waste recycling target that is date-specific, a plastic ban whose micron thresholds shifted twice on different dates, and a waste-to-energy sector whose real installed capacity has consistently undershot its own official targets. This note works through five clusters, solid waste rules, e-waste and EPR, the plastic ban, hazardous waste, and waste-to-energy, each anchored to the rules' own text or a verified government figure.
Solid Waste Management Rules, 2016
The Solid Waste Management Rules, 2016 were notified by MoEFCC on 8 April 2016 under the Environment (Protection) Act, 1986, superseding the Municipal Solid Waste (Management and Handling) Rules, 2000. Rule 4 places the first duty on the generator: every waste generator must segregate and store waste in three separate streams, biodegradable, non-biodegradable and domestic hazardous waste, in suitable bins, and hand over the segregated waste to authorised waste pickers or collectors. A bulk waste generator is defined as any establishment with an average waste generation rate exceeding 100 kg a day, a threshold that brings hotels, hostels, large residential complexes and institutions under stricter, time-bound obligations, including on-site composting or bio-methanation of biodegradable waste "as far as possible" within one year of notification.
Rule 15 fixes local authorities' duties in detail, and this is where most specific facts are tested. Local bodies must colour-code storage bins: green for biodegradable waste, blue for recyclable waste (amended from white to blue in 2019) and black for other waste. They must set up one domestic hazardous waste deposition centre for every 20 square kilometres of a city, and must establish a system to recognise organisations of waste pickers and informal waste collectors, issuing identity cards and integrating them into door-to-door collection, a provision that formally acknowledges the informal sector's central role rather than displacing it. The rules define a waste picker as a person informally engaged in collecting and recovering reusable and recyclable waste for sale to recyclers to earn a livelihood, and require local bodies to run a scheme for registering waste pickers and waste dealers.
The rules also set a waste hierarchy, prevention, reduction, reuse, recycling, recovery and disposal, in that order of preference, with landfilling the least preferred option; local bodies must stop landfilling mixed waste and send only non-usable, non-recyclable, non-combustible inert residues to sanitary landfills, with every effort made toward zero waste to landfill. Manufacturers and brand owners of non-biodegradable packaging must provide financial assistance to local bodies for waste management and put in place a system to collect back their packaging waste, an early domestic articulation of extended producer responsibility that predates the dedicated EPR rules for e-waste and plastic.
E-Waste and Extended Producer Responsibility
The E-Waste (Management) Rules, 2022 were notified on 2 November 2022 and came into force on 1 April 2023, replacing the E-Waste (Management) Rules, 2016. The scope expanded sharply: the 2016 rules covered only 21 categories of information-technology and consumer electronic equipment, while the 2022 rules cover 106 types of electrical and electronic equipment (EEE) across seven broad categories under Schedule I, adding items such as tablets, GPS devices, solar photovoltaic modules, medical devices and laboratory instruments.
The rules run on an EPR certificate-trading mechanism administered through a CPCB portal. Producers, manufacturers, refurbishers and recyclers must all register on this portal (dismantlers and bulk consumers are not required to). Every producer is assigned a phased recycling target as a share of its estimated e-waste generation: 60% for FY 2023-24 and FY 2024-25, 70% for FY 2025-26 and FY 2026-27, and 80% from FY 2027-28 onward (a new producer's target is instead based on a fixed share of its sales two years prior, per Schedule IV). A producer discharges this obligation by purchasing EPR certificates generated by registered recyclers, and certificates are issued in terms of four recovered end products by weight: gold, copper, aluminium and iron. A producer importing used EEE faces a 100% recycling target on the quantity imported. Solar photovoltaic waste is covered by the rules but carries no recycling target, only a requirement to store the waste until 2034-35 pending CPCB guidelines.
The rules also carry a RoHS (Reduction of Hazardous Substances) provision: new EEE and its components must not contain lead, mercury, hexavalent chromium, polybrominated biphenyls (PBB) or polybrominated diphenyl ethers (PBDE) beyond 0.1% by weight, or cadmium beyond 0.01% by weight, in homogeneous materials, with phased exemption timelines for specific equipment categories running to 2025 and 2028. Waste batteries and packaging plastics are explicitly excluded from these rules, since they are separately covered by the Battery Waste Management Rules, 2022 and the Plastic Waste Management Rules, 2016, a distinction worth remembering when a question asks which rules govern a specific waste stream.
Plastic Waste Management: the single-use ban
The Plastic Waste Management (Amendment) Rules, 2021, notified on 12 August 2021, banned the manufacture, import, stocking, distribution, sale and use of a defined list of single-use plastic items with low utility and high littering potential, effective 1 July 2022. The banned items include ear buds with plastic sticks, plastic sticks for balloons, plastic flags, candy and ice-cream sticks, polystyrene (thermocol) for decoration, plastic plates, cups, glasses and cutlery (forks, spoons, knives, straws, trays), wrapping or packing films around sweet boxes, invitation cards and cigarette packets, and plastic or PVC banners under 100 micron thickness.
The same amendment tightened plastic carry bag thickness on two separate dates, a favourite exam trap because the two thresholds are easy to swap: the minimum thickness rose from 50 to 75 microns effective 30 September 2021, and from 75 to 120 microns effective 31 December 2022, the second increase intended to make bags durable enough for reuse rather than single use. Plastic packaging that falls outside the single-use ban, most flexible and rigid packaging, is instead governed through Extended Producer Responsibility: guidelines issued under the Plastic Waste Management Rules classify packaging into four categories, rigid plastic packaging, flexible single or multi-layer packaging (carry bags, sachets, pouches), multi-layered packaging combining plastic and non-plastic layers, and compostable plastic packaging, each with its own collection, recycling and reuse targets for the producer, importer and brand owner (PIBO), registered and tracked through a centralised CPCB portal.
Industrial hazardous waste
Hazardous waste in India has been regulated since the Hazardous Waste (Management and Handling) Rules, 1989, revised into the Hazardous Waste (Management, Handling and Transboundary Movement) Rules, 2008, and currently governed by the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, notified by MoEFCC on 4 April 2016 under the Environment (Protection) Act, 1986. The 2016 rules widened coverage to include other wastes such as waste tyres, paper waste, metal scrap and used electronic items alongside classically hazardous industrial waste. India has been a party to the Basel Convention on the transboundary movement of hazardous waste since 1992, and the rules implement that treaty domestically: hazardous waste cannot be imported into India for disposal, only for recycling, recovery, reuse or co-processing, and only with prior authorisation from MoEFCC and the Directorate General of Foreign Trade.
Every occupier generating hazardous waste needs authorisation from the State Pollution Control Board, and waste that cannot be recycled or reused must go to a Common Hazardous Waste Treatment, Storage and Disposal Facility (TSDF), typically a secured landfill or incinerator shared across generators in an industrial cluster. Co-processing, using hazardous waste with sufficient calorific value as a substitute fuel or raw material in industrial processes such as cement kilns, is the rules' preferred alternative to landfilling or standalone incineration, since it recovers energy and material value simultaneously. According to CPCB's own 2010 estimate, India generated roughly 7.66 million tonnes of hazardous waste a year from about 40,722 industries, split roughly 44% landfillable, 47% recyclable and 9% incinerable, with a small cluster of industrialised states, including Gujarat, Maharashtra, Tamil Nadu and Andhra Pradesh, accounting for the large majority of national generation.
Waste-to-energy technologies
Three technologies dominate India's waste-to-energy sector, and the Solid Waste Management Rules, 2016 define each precisely. Incineration is the engineered combustion of solid waste at high temperature to thermally degrade it, typically to generate electricity. Refuse-derived fuel (RDF) is fuel manufactured from the combustible, non-chlorinated fraction of solid waste, plastic, wood, pulp and organic matter, by drying, shredding, dehydrating and compacting it into pellets or fluff, used to replace conventional fuel in cement kilns or dedicated RDF-based power plants. Bio-methanation is an anaerobic digestion process in which microbial action breaks down biodegradable waste to produce methane-rich biogas, suited to segregated wet waste rather than mixed municipal waste.
Waste-to-energy gained policy momentum after the Swachh Bharat Mission, which offers viability gap funding of 35% of project cost for municipal solid waste management projects, including waste-to-energy. But the sector's real record has consistently fallen short of official ambition, and this gap is itself a recurring exam angle. NITI Aayog's own targets called for 330 MW of waste-to-energy capacity within months and 511 MW by 2018-19, starting from a base of roughly 63 MW in 2017; actual installed capacity never came close, and a majority of India's early incineration plants, including the country's first, at Timarpur in Delhi, shut down within weeks of commissioning because Indian mixed municipal waste has a far lower calorific value than the waste streams such plants were originally designed around, a mismatch rooted directly in the poor segregation this chapter's first section addresses. A CPCB study of India's waste composition found the organic, high-moisture fraction typically makes up 40 to 60% of municipal solid waste by weight, which suppresses its heat value and explains why cities such as Delhi have found only a small fraction of daily waste, historically well under a fifth, suitable for direct incineration without extensive pre-processing. The underlying exam point: waste-to-energy is not a substitute for source segregation, it depends on it, since RDF and incineration both need a dry, high-calorific feedstock that only segregated collection can reliably supply.
Exam angle
This chapter is tested through dates, thresholds and the specific document a fact belongs to, not general awareness of "India has waste rules." The three-way segregation of the 2016 rules (biodegradable, non-biodegradable, domestic hazardous) is frequently reduced to a wet-dry pair in incorrect options. The e-waste EPR recycling targets are phased by financial year, so a number quoted without its FY is incomplete, and a question may also test which four metals EPR certificates are actually denominated in, gold, copper, aluminium and iron, not a generic "e-waste recycled" percentage. The plastic ban carries two separate, easily confused thresholds: the single-use item ban took effect 1 July 2022, while carry bag thickness moved on two different dates, 30 September 2021 and 31 December 2022, and mixing these three dates is the most common trap in this cluster. Waste-to-energy is usually tested as a critical-thinking statement rather than a pure fact: a question describing WtE as a proven solution to India's waste crisis is testing whether the aspirant knows the sector's targets were missed and early plants failed specifically because of unsegregated, low-calorific feedstock.
